Dear Whistleblower,
Decree no. 24 of 10 March 2023, containing the new whistleblowing regulations, introduces into our
regulations aimed at protecting those who report particular violations of national law or
of the European Union and has, as its main purpose, that of bringing to light illicit conduct of which the whistleblower
has become known within the working context, providing for the creation of specific communication channels
communication that guarantees the confidentiality of the identity of the reporting person, of the person involved
and of those possibly mentioned in the report, as well as the content of the report itself e
of the relevant documentation.
The entities falling within the scope of application of the whistleblowing regulations are, therefore, obliged to
activate an adequate internal reporting channel, which meets the requirements required by law. The channels of
internal reporting, to be considered adequate, must be capable of ensuring confidentiality
of the identity of the reporter (distinguishing the concept of "confidentiality of the identity of the reporter" from that
of anonymity, as anonymous reports are not considered whistleblowing) and of people
involved (reported, facilitator, any other third parties), the content of the report and the documentation
relating to it.
Through this platform, the whistleblower therefore has the possibility of reporting any illicit conduct
learned about in the work context.
In order to enjoy the guarantees referred to in the Whistleblowing Decree, it is necessary for the whistleblower to provide the
own data, without prejudice, however, that the reporting may also take place anonymously: in this case, the
reporting may follow a different path (where, for example, this is provided for by a specific procedure
company) or the reporting party will be able to identify themselves at a later time, being assured at that point
protections referred to in the Decree, in particular where he has suffered retaliation.
